Terms of Use
These terms govern your use of the redfly.ai marketing website. Your use of the redfly product itself is governed by the redfly License Agreement, described in Section 2.
1. The website
The redfly.ai website is provided by Nautilus Research, Inc., doing business as redfly.ai ("redfly", "we", "us", or "our") as informational content about our products and services. The information here is accurate to the best of our knowledge at the time of writing, but it is not a contract, an offer, or a warranty, and we may change it at any time.
2. The product
The redfly synchronization service is purchased and provisioned directly from redfly. The License Agreement is the binding agreement between you (or your organization) and redfly for the product itself. In the event of any conflict between these website terms and that License Agreement, the License Agreement controls with respect to the product.
3. Accounts and acceptable use
You are responsible for the accuracy of the information you provide and for any activity carried out under your account. You agree not to attempt to compromise the security, availability, or integrity of the redfly.ai website or the redfly service, not to access them by any means other than the interfaces we provide, and not to use them in any way that violates applicable law or infringes the rights of others.
4. Intellectual property and trademarks
The content, design, and software of the redfly.ai website are owned by redfly or our licensors and are protected by intellectual property laws. "redfly" and the redfly.ai logo are marks of redfly.ai. All other product and company names referenced on this site, including Microsoft, Azure, SQL Server, Redis, and MongoDB, are trademarks of their respective owners and are used for identification only; their use does not imply any endorsement.
5. Disclaimers and limitation of liability
The redfly.ai website is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. To the maximum extent permitted by applicable law, redfly will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, this website. Nothing in these terms limits any liability that cannot be limited under applicable law. Warranties and liability for the redfly product are addressed in the License Agreement referenced in Section 2.
6. Changes to these terms
We may update these terms from time to time. When we do, we will revise the "Last updated" date below. Material changes will be reflected here, and your continued use of the website constitutes acceptance of the updated terms.
7. Governing law
These terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-laws rules. This Section 7 applies to these website terms; the governing law for the product is set out in the License Agreement referenced in Section 2.
